Standard terms & conditions for Stabilisation & Modification works

1. The Client must check all materials considered for treatment for any objects that may cause damage to either our staff or machines. Any subsequent damage will be charged to the client in full. The material to be treated will be prepared, levelled and compacted by others prior to stabilisation, to a level not exceeding 300mm, unless otherwise agreed.
2. All setting out of areas to be undertaken by others using laser control, profile boards/pins or as otherwise agreed.
3. We are responsible for the stabilised layers only. Beach will not accept any liability for untreated layers below or surrounding the stabilisation layer or for the failure of the treated layer caused by the untreated layer below/surrounding. Material with a CBR <2% can be treated, although this may reduce production outputs, or alter the working method.
4. The provision of a clean water supply is the responsibility of others. The water should be no more than 500metres from the working area and should be of the high-output feed type.
5. Access to the working area must be available at all times and must be maintained in order to allow for the delivery, by bulk tanker, of materials required for the works.
6. Due to the nature of stabilisation, access to the site must be maintained at all times.
7. We will provide a finished stabilised layer with a tolerance of +20mm/ –30mm unless otherwise agreed, providing the underlying material to be stabilised is prepared to the same standard by others.
8. Due to the dimensions of the stabilisation plant, we will not treat within 500mm of any immovable objects, manhole covers, profiles or such like. Any infill work around these areas is the responsibility of others.
9. Soils treated to Capping or Sub-base specification will normally be sealed with a bitumen spray coating to enable the curing process to take place efficiently. However, prior to the commencement of spraying, or the laying of any subsequent materials, the client will check the areas for levels. Failure to do so removes Beach liability for any remediation works.
10. It is the responsibility of others to provide adequate drainage of the stabilised layers in order to eliminate standing water and the ingress of water to any underlying stabilised layers.
11. We require a prepared working area of not less than 3500m2 per day ahead of the stabilisation works or greater should our contract conditions dictate.
12. We will not be liable for any costs incurred due to unforeseen or unexpected soil conditions that differ from any site investigation or soils testing data provided to ourselves. We will accept no liability for any delays in our works due to any weather conditions. This includes test results falling below the required level due to frost, or any other factor.
13. The removal of any surplus material as a result of the stabilisation process is the responsibility of others.
14. Protection of the treated material, once sealed, is the responsibility of others. We will accept no liability for environmental or traffic damage of the treated layer before sufficient curing has taken place. The curing period is to be agreed between Beach and the client.
15. A standing charge of £550.00 per hour, or 10% per hour of the daily production target rate will be incurred for any reasons beyond the control of Beach, which ever is greatest. A production day is based on 10 (ten) hours. Price is per set of plant/gang. Charges incurred by binder suppliers will also be passed on.
16. All estimates submitted are on the basis of full acceptance of these and any other terms and conditions that may be required for individual contracts.
17. In the absence of any specifically agreed contract documentation, these terms and conditions will apply in their entirety.
18. All estimates are based on the information received from the client. Any alterations in design or specification must be submitted in writing to Beach and may be subjected to re-pricing if deemed necessary by us.
19. At least four weeks notice is required of commencement date, unless otherwise agreed.
20. All stabilisation works are carried out in accordance with our Method Statement, which is available on request or prior to the commencement of any stabilisation works.
21. If undertaken by us, Beach reserve the right to charge, in full, for any testing of materials should it be decided by others not to proceed with Beach Soil Stabilisation Ltd or stabilisation.
22. All conversations, documentation or any other items regarding Beach Stabilisation Ltd and their contracts are strictly confidential and must not be duplicated, displayed or communicated in any way without the prior, written consent from the Management of Beach Soil Stabilisation Ltd. Failure to do so will result in legal action against all parties concerned.
